This tool is provided to estimate general holiday entitlement and pay under the Canada Labour Code, Part III for general holidays occurring AFTER March 16, 2015.
This tool does not create a Labour Standards Complaint nor will it start an investigation by Employment and Social Development Canada – Labour Program. If incorrect information is used, this tool will produce incorrect results. This tool does not provide specific advice or recommendations. In addition, there may also be other factors that affect the outcome and an investigation by the Labour Program could produce a different result.

- This general holiday calculator is intended for use by employees NOT covered by a collective agreement who wish to estimate their minimum entitlements under Federal Labour Standards. If you are covered by a collective agreement you should consult with your union representative.
- This calculator provides results for most standard employment situations. There are many unique situations which cannot be addressed in a general calculator. If you are unsure of your situation, you should speak with your employer or contact us.
- To use this general holiday calculator you should have copies of your detailed pay stubs and hours worked. The more accurately you enter information, the more accurate your results will be.
- You will be asked a series of questions which will determine whether you are eligible for
- time off for a general holiday,
- general holiday pay, and
- additional pay if you worked on the general holiday
- If you are eligible, you will be given the opportunity to calculate your approximate entitlement.

If the day you wish to select is not listed then pick the option "Substituted Day (Pursuant to section 195)". You will be given the opportunity to select any day from the calendar which appears. All calculations will be based on the date you select as a general holiday.
Note
The Labour Program can only recover general holiday pay owed going back two years from either the date of a complaint or from a date of termination.

Continuous operations do not run on a
fixed, Monday to Friday, 9 am to 5 pm work schedule.
These types of operations run "continuously", without stopping their operations for holidays or
weekends.
General
Holidays - Continuous Operations
“Employed in a continuous operation” means, in respect of an employee, employment in
(a) any industrial establishment in which, in each seven-day period, operations once begun
normally continue without cessation until the completion of the regularly scheduled operations for
that period;
(b) any operations or services concerned with the running of trains, planes, ships, trucks or
other vehicles, whether in scheduled or non-scheduled operations;
(c) any telephone, radio, television, telegraph or other communication or broadcasting
operations or services; or
(d) any operation or service normally carried on without regard to Sundays or general
holidays.
Continuous operations do not have the luxury of shutting down for holidays or only
operating during normal business hours such as Monday to Friday from 9 to 5. These types of
operations run "continuously", without regard to holidays or weekends. As a result, special provisions
exist in the law to accommodate these operations.

Where there is no actual provision for "booking off" a general holiday in a continuous operation, and an employee is called to work for the general holiday, if the employee does not report for work on that day then the employer does not have to pay the employee for the general holiday.

If an employer schedules an employee to work on a general holiday and the employee does not report to work on that day, the employer is not required to pay that employee for the general holiday. It should be noted however that an employee simply stating a preference ahead of time as to days off, does not mean that an employee would refuse a shift if one was scheduled.

Some collective agreements or company policies allow employees to make themselves unavailable for work. The collective agreement or company policy must establish a practice that allows an employee to remove their name from a future work schedule for a specific time period; which in effect does not allow the employer to schedule the employee for work during that time period. If an employee is unavailable to work on a general holiday, the employer does not have to pay the employee for the general holiday.

You indicated you are a manager or a working professional (architectural, dental, engineering, legal or medical professional).
You are entitled to a general holiday with pay. If you were required to work on a general holiday, you are entitled to a holiday with pay at some other time, either by having it added to your annual vacation or by having it granted at another time convenient to both you and your employer.
No general holiday pay entitlement
You are not entitled to general holiday pay for because you indicated that you are employed in a continuous operation and that, although you worked on , you were given a holiday with pay at another time, either by having it added to your annual vacation or by having it granted at a time convenient to both yourself and your employer. you were subject to a collective agreement that is binding on yourself and your employer and provides that you are paid holiday pay for the first day on which you do not work after the general holiday. because you are employed in a continuous operation and you were called to work on the general holiday day but did not report. because you are employed in a continuous operation and the conditions of employment where you work required you to be available on the general holiday but you made yourself unavailable. because you are employed in a continuous operation and the conditions of employment where you work allow you to make yourself unavailable for work and you made yourself unavailable.
You are therefore not entitled to general holiday pay.
You are entitled to be paid for the hours you work as if the day were a regular day of work.
You indicated that you are entitled to general holiday pay for the following holiday because:
- you were working in a continuous operation;
- you were NOT working in a continuous operation;
- you indicated that you worked on ;
- you were NOT a manager OR an architectural, dental, engineering, legal or medical professional or working in one of those professions.
This entitles you to be paid wages at a rate equal to at least one and one-half times your regular rate of wages for the time that you worked on that day.
This method for calculating your general holiday pay applies to you because you indicated you:
- were required to work on the general holiday;
- were NOT required to work on the general holiday;
- were working in whole or in part on commission.
- were NOT working on commission.
- were working on commission but had not completed at least 12 weeks continuous employment with this employer.
